Terms of Service

These terms (in Polish: *regulamin*) set out the rules for using Tennis Warsaw — the website tenniswarsaw.club and tennis-warszawa.com, the Telegram Mini App and our Telegram bot — and Crabo, the mobile app for iPhone and Android (together, the Service). They are the terms referred to in article 8 of the Polish Act on Providing Services by Electronic Means. Please read them together with the Community rules, which are part of these terms, and the Privacy policy.

You can open, save and print these terms at any time, free of charge.

You can contact us by email at support@tenniswarsaw.club (general matters and complaints) or privacy@tenniswarsaw.club (personal data), and by writing to our Telegram bot or using Support → Report a problem in the app. The points of contact required by the Digital Services Act are described in section 13.

2. Definitions

  • Service — the website, the Telegram Mini App, the Telegram bot and the Crabo app, with all their features.
  • User (you) — anyone who uses the Service, with or without an account.
  • Account — your personal account in the Service. One account works on the website, in the Mini App and in the app.
  • Event — a tournament, league, competition, match or other sports activity organised or recorded in the Service.
  • Organiser — the person or entity named as running an Event: the club or another organiser.
  • Coach — a user who offers tennis or padel lessons through the Service, under the Terms for coaches as well as these terms.
  • Content — anything users put into the Service: profile details, photos, videos, messages, notes, reviews, results and links.
  • Consumer — a natural person who uses the Service for purposes not directly related to their business or profession.

3. Services we provide

The Service is a platform for the tennis and padel community. Using it is free of charge. It lets you:

  1. create an account and a player profile (name, photo, sports, playing level, contacts you choose to show, preferences);
  2. take part in Events: see announcements, register, join waiting lists, confirm attendance, withdraw or offer your place to someone else, see draws, schedules and court assignments, enter and confirm scores;
  3. see results, standings, rankings, levels and achievements;
  4. find partners: create and answer match requests, share open court slots and invite other players;
  5. write to other users in the chat;
  6. find a coach, book lessons and, for Coaches, run a lesson calendar (see the Terms for coaches);
  7. check court availability at Warsaw clubs (based on the clubs' public booking pages), get alerts when a court frees up and see where other players play;
  8. receive notifications through our Telegram bot, push notifications and posts in the club's Telegram group;
  9. upload short videos of your game to your profile;
  10. support the club with voluntary donations and, on the website, pay amounts you owe for Events (see section 9);
  11. download your data or delete your account at any time.

Some features are available only in some parts of the Service (for example, donations only in the Telegram Mini App). We develop the Service continuously and may add, change or remove features; if a change affects your rights under these terms, section 19 applies.

4. Technical requirements

To use the Service you need an internet connection and one of the following:

  • website: a recent version of Chrome, Safari, Firefox or Edge with JavaScript enabled and cookies and local storage allowed;
  • Telegram Mini App and bot: a current version of the Telegram app;
  • Crabo app: an iPhone with iOS 15.1 or later, or an Android device with Android 7.0 or later.

To sign in you need a Telegram account, a Google account, an email address or a mobile phone number. To receive notifications you must allow them on your device or in your browser, and start our bot in Telegram for bot messages. The information the Service stores on your device (cookies and similar storage) is described in the Privacy policy.

5. Your account and the agreement

  • Age. You must be at least 16 years old to create an account.
  • Agreement. The agreement for the Service is concluded when you create an account, that is when you first sign in and accept these terms. It runs for an indefinite period until you or we end it (section 15). Browsing public pages without an account is a separate service that ends when you leave the page.
  • Accurate details. Use your real first and last name and keep your profile truthful — Events, results and rankings depend on it. Your self-rated playing level should be honest.
  • One account per person. Do not create accounts for other people, share your account or create extra accounts, for example to get around a restriction or influence rankings.
  • Security. You sign in through Telegram, Google, or a one-time code sent to your email or phone; keep access to them secure. We will never ask you for a sign-in code. Tell us at once at support@tenniswarsaw.club if you suspect someone else is using your account.
  • Coaches accept the Terms for coaches before their coach profile is published.

6. Rules of use and prohibited content

You must use the Service in accordance with the law, these terms, the Community rules and good manners. In particular, you must not provide unlawful content. We have zero tolerance for:

  • harassment, bullying, intimidation and threats;
  • hate speech and slurs, and discrimination based on origin, nationality, religion, sex, sexual orientation, disability or any similar ground;
  • sexual content, and any content that sexualises minors (which we report to the authorities);
  • violence, incitement to violence or glorification of it;
  • spam, scams, fraud and unsolicited advertising;
  • impersonating another person or organisation, and fake profiles;
  • publishing other people's personal data (for example contact details) or images without their permission;
  • content that infringes copyright, trademarks or other rights;
  • entering false results, manipulating rankings or levels;
  • malware, attempts to break into the Service, overload it, bypass its security, or collect data from it automatically (scraping), and circumventing a restriction imposed on you.

Content or behaviour that breaks these rules may be removed and may lead to a warning, a posting ban or the end of your account, as described in section 11.

7. Your content and the licence you give us

Content you add remains yours. You are responsible for it and confirm that you have the right to publish it — including the consent of people who appear in your photos or videos.

So that we can run the Service, you grant us a non-exclusive, free-of-charge licence, without territorial limits, to use your Content only to operate and provide the Service, in the following fields of exploitation: recording and storing it on servers, making copies necessary for storage, backup and transmission, adapting its technical format (for example resizing a photo or making a video poster frame), and displaying and making it available in the Service to the people who can see it under the Service's settings. The licence lasts as long as the Content is in the Service and ends when it is deleted, except for copies in backups until they are overwritten and results kept as described in the Privacy policy. We may let our technical providers use the Content only to the extent needed to provide these functions.

We will not use your photos or videos to promote the Service outside it (for example in club videos on social networks) without your separate consent.

The Service itself — its software, design, name and logos — belongs to us or our licensors. You may use it only as these terms allow.

8. Events: tournaments, leagues and matches

  • Organiser's rules. Each Event has its own rules set by its Organiser and shown in the Service (format, level limits, number of places, schedule, withdrawal deadline, entry fee and prizes). By registering you accept them. The Organiser runs the Event, decides disputes about it and may change or cancel it; you will be notified in the Service.
  • Registration. Places are given in the order and under the conditions the Event describes: when an Event is full or you do not meet its level limit you join the waiting list, and waiting-list players are moved up automatically when a place frees up. A player who has repeatedly withdrawn without playing may be registered as a reserve. Organisers can review these decisions.
  • Withdrawal and replacements. You can withdraw until the Event's deadline. After it you may offer your place to another player, who must accept it.
  • Results. Enter scores honestly and promptly; the opponent or the Organiser can confirm or correct them. Results, standings and rankings are visible to others (Privacy policy).
  • Sport and health. Tennis and padel involve physical effort and a risk of injury. You take part at your own risk and should play only if your health allows it. Follow the rules of the venue and fair play.
  • Photos and videos at Events. Organisers may take photos and short videos at Events. They are published in the Service or in the club's channels only as described in the Privacy policy.

9. Entry fees, payments and donations

  • The Service is free. We do not charge you for an account or for using the Service's features.
  • Entry fees. Some Events have an entry fee, set by the Organiser and shown in the Event. It is the price of taking part in a real-world sports event, not of anything digital. You can pay it in cash to the Organiser at the Event, or from your balance.
  • Balance (tPLN). The Service keeps a balance for you in tPLN, an internal unit used only to pay entry fees for Events in the Service. You can top it up in cash with an Organiser at an Event or, on the website, with cryptocurrency through an external payment provider, which handles the payment on its own page and under its own terms (we receive only the payment status). When you register for an Event, the fee is taken from your balance if it covers it; unpaid fees for Events you took part in are shown as a negative balance. Refunds, for example after you withdraw before the deadline, are credited to your balance. The balance is not money: it cannot be paid out or transferred to another person. The Crabo app does not take payments.
  • Promotions. Rewards such as a free entry for inviting friends follow the rules shown in the Service.
  • Donations. You can support the club with voluntary donations in Telegram Stars in the Telegram Mini App, once or as a monthly subscription. Payments in Stars are processed by Telegram under its terms; you manage or cancel a subscription in Telegram (Settings → My Stars). Donors get a supporter badge and a star on their profile; monthly supporters are also registered automatically for new tournaments when registration opens, and can withdraw from any of them in the usual way.
  • Invoices and records. We keep payment records as accounting law requires (Privacy policy).

10. Coaches and lessons

Coaches are independent professionals. A lesson agreement is concluded directly between you and the Coach; we are not a party to it and do not collect lesson fees. The Coach is responsible for the lesson, its price, conditions and cancellation rules, which the Coach shows in the Service. Lessons for children under 16 are booked and managed by their parent or guardian. Reviews of Coaches must describe your own genuine experience. The rules for Coaches are in the Terms for coaches.

11. Content moderation

We keep the Service safe with the following tools:

  • Report. Any signed-in user can report a message, a profile, a coach profile or review, a link, a video, an open slot or a match request with the Report option next to it, choosing a reason (spam, harassment, hate, sexual content, violence, impersonation or other).
  • Block. You can block another user. A block keeps you apart everywhere — no messages, invitations, lesson bookings or slot offers between you — and the blocked user is not told.
  • Automatic filter. When you post text, the Service automatically checks it for obvious slurs, more than three links, or known scam and spam patterns. Such text is not published and you are told why. The filter does not make decisions about accounts.
  • Telegram group. Our bot automatically removes messages that match known spam and scam patterns in the club's Telegram group and can remove their senders from the group.
  • Human review. Reports are reviewed by our administrators, who decide on every restriction of content or of an account. They act diligently, objectively and proportionately, taking into account the rights and legitimate interests of everyone involved, including freedom of expression.

Depending on how serious and repeated the breach is, we may: remove content, warn you, ban you from posting (you can still sign in, read, download your data and delete your account), or end your account (section 15). Organisers may also refuse or cancel a registration for an Event under its rules.

Statement of reasons. If we restrict your content or account, we tell you through the Service, the bot or by email, stating what we decided, the facts and circumstances (including whether it followed a report), the rule or law it is based on, whether automated means were used, and how you can appeal. We may omit it only where the law requires or allows (for example, for deceptive high-volume commercial content).

Appeal. You can appeal a decision within 6 months by replying to the statement of reasons or writing to support@tenniswarsaw.club. A person who was not involved in the original decision, where possible, will review it, and we will answer within 14 days. You can also go to court.

12. Reporting illegal content

Anyone, including people without an account, can tell us about content in the Service that they consider illegal: use Report in the Service or write to support@tenniswarsaw.club. To let us act on a notice, please include:

  1. an explanation of why you consider the content illegal;
  2. where exactly it is (a link, or the screen, user name and date);
  3. your name and email address (not required when reporting content related to the sexual abuse or exploitation of children);
  4. a statement that you believe in good faith that the notice is accurate and complete.

We confirm receipt of the notice, review it promptly, diligently and objectively, and tell you our decision and how you can challenge it. We tell you if the decision was made with automated means.

Threats to life or safety. If we learn of information giving rise to a suspicion that a criminal offence involving a threat to the life or safety of a person has taken place, is taking place or is likely to take place, we promptly inform the competent law enforcement or judicial authorities and give them the information we have. In an emergency, call 112.

13. Points of contact (Digital Services Act)

  • For authorities of the EU Member States, the European Commission and the European Board for Digital Services (article 11 DSA): support@tenniswarsaw.club. Languages: Polish and English.
  • For users (article 12 DSA): support@tenniswarsaw.club, Support → Report a problem in the Service, or our Telegram bot. You will always reach a person, not only an automated system. Languages: Polish, English, Ukrainian and Russian.

14. Complaints

If the Service does not work as it should or as these terms describe, you can file a complaint:

  • by email to support@tenniswarsaw.club,
  • through Support → Report a problem in the Service, or
  • by post to [TODO: registered address].

Please describe the problem, when it happened and what you expect, and give your name and a contact address so we can reply. We answer within 14 days of receiving the complaint, in the way you contacted us unless you ask otherwise. If your complaint concerns an Event, we pass it to the Organiser and tell you.

Consumers can also use out-of-court ways of resolving complaints, for example the help of a municipal or district consumer ombudsman (*rzecznik konsumentów*) or mediation by the Trade Inspection (*Inspekcja Handlowa*). Information is available at prawakonsumenta.uokik.gov.pl. Consumers from other EU countries can contact the European Consumer Centre in their country. Using these options is voluntary.

15. Ending the agreement

By you — at any time, free of charge. Delete your account in Profile → ⚙️ Settings → Privacy & data → Delete account (in the app, the Mini App or on the website) or write to privacy@tenniswarsaw.club. Deleting the account ends the agreement immediately. What happens to your data is explained on the account deletion page.

By us. We may end the agreement:

  • with 30 days' notice for an important reason: if we stop providing the Service or a significant part of it, if the law or a decision of an authority requires it, or if continuing would expose the Service or its users to a serious security risk;
  • without notice if you seriously or persistently break the law, these terms or the Community rules — for example by publishing illegal content, threatening or harassing others, fraud, or getting around an earlier restriction — usually after a warning, unless the breach makes a warning pointless.

We send you a statement of reasons when we end your account (section 11). You can download your data before the account is closed, unless the law prevents it.

16. Liability

We are liable under the general provisions of law, and we do our best to keep the Service working and secure. However:

  • the Service may be temporarily unavailable because of maintenance, updates or failures beyond our control, and we will try to announce planned breaks in advance;
  • we are not responsible for Events run by other Organisers, for lessons (a matter between you and the Coach), or for the behaviour of other users outside the Service;
  • information about court availability comes from the clubs' public pages and may be out of date — the club's own booking system decides;
  • we are not responsible for Content posted by users, but we act on reports and remove illegal content as described in section 12;
  • third-party services, such as Telegram, Google, Apple or payment providers, are provided by those companies under their own terms.

Nothing in these terms excludes or limits our liability where the law does not allow it — in particular for damage caused intentionally or through gross negligence, for personal injury, or the rights consumers have under mandatory law.

17. Consumer rights

If you are a Consumer:

  • the Service must conform to these terms and to the law, in particular the Polish Consumer Rights Act. If it does not, you have the rights provided by law, including to have it brought into conformity or, in the cases the law describes, to end the agreement;
  • you can end the agreement at any time without giving reasons (section 15), so no separate withdrawal period is needed for the free Service. Entry fees are paid for sports events on a set date, for which the law excludes the right of withdrawal from a distance contract; refunds follow the Event's rules;
  • nothing in these terms limits the protection given to you by the mandatory law of the country where you habitually live.

A natural person who runs a business and uses the Service for purposes that are not of a professional nature for them has the same protection as a Consumer to the extent provided by Polish law.

18. Risks of using online services

Using any online service carries risks, such as malware, phishing (messages pretending to be from us to steal your account), spam, or someone impersonating another person. To stay safe: keep your devices and apps up to date, never share one-time sign-in codes, check that you are on tenniswarsaw.club and tennis-warszawa.com or in our official bot, be careful with links from strangers, and report suspicious accounts. We will never ask you for a sign-in code or a password.

19. Changes to these terms

We may change these terms for important reasons: a change in the law or a decision of an authority, new features or changes to existing ones, security reasons, preventing abuse, or a change in our details. We will tell you about a change in the Service and through the bot or by email at least 15 days before it takes effect, unless the law requires a faster change. If you do not agree with the change, you can end the agreement before it takes effect by deleting your account. Changes do not apply to Event registrations made before them.

20. Final provisions

  • These terms are governed by Polish law. For Consumers this does not limit the protection given by the mandatory law of their country.
  • Disputes are resolved by the competent common courts. A Consumer may bring a claim before the courts of their place of residence as EU law allows.
  • These terms are available in Polish, English, Ukrainian and Russian. In case of any discrepancy, the Polish version prevails.
  • If any provision is found invalid, the rest remain in force.
  • These terms take effect on the date given at the top of this page.
